1. AGREEMENT

This End-User License Agreement ("EULA") is a legal agreement between you ("you" or "user") and SOCBOOST LTD. ("we," "us," or "our"), governing your use of the Social Profile Analyzer mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree with these terms, do not download, install, or use the App.

We may update this EULA from time to time. Material changes will be communicated through an in-app notification or other reasonable means. Your continued use of the App after such changes constitutes acceptance of the updated terms.

2. ELIGIBILITY AND AGE REQUIREMENTS

You must be at least 13 years old to use the App. If you are between 13 and 18, you must have your parent or legal guardian review and agree to this EULA on your behalf. By allowing a minor to use the App, parents or guardians agree to be bound by this EULA and are responsible for supervising the minor’s activities within the App.

3. LICENSE TO USE THE APP

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a mobile device you own or control, solely for personal, non-commercial purposes. This license does not permit you to:

  • Modify, reverse-engineer, decompile, or disassemble the App.

  • Rent, lease, sell, distribute, or sublicense the App.

  • Use the App for any unlawful or unauthorized purpose.

4. SCOPE OF ANALYSIS AND DATA USAGE

The App analyzes only publicly available profiles and data from social media platforms, using information that is accessible without requiring user authentication or private account access. We do not access, collect, or process non-public or private data. By using the App, you acknowledge that:

  • Analysis is limited to public profiles and publicly available data.

  • You are responsible for ensuring that your use of the App complies with the terms of service of the relevant social media platforms.

  • We do not guarantee the accuracy, completeness, or timeliness of the analyzed data.

5. RESTRICTIONS ON USE

You agree not to:

  • Use the App to collect, store, or share data in violation of applicable laws or third-party rights.

  • Attempt to bypass any security measures or interfere with the App’s functionality.

  • Use automated tools (e.g., bots, scrapers) to access or extract data through the App.

  • Share or publish analysis results in a way that violates privacy, intellectual property, or other rights.

6. PRIVACY AND DATA COLLECTION

Your use of the App is subject to our Privacy Policy, incorporated herein by reference. We may collect technical data (e.g., device information, usage statistics) to improve the App and provide updates. We do not collect or store personal data beyond what is necessary for the App’s functionality, and we do not access private social media data. You consent to our use of technical data as described in the Privacy Policy.

7. INTELLECTUAL PROPERTY

The App, including its design, code, text, graphics, and other content, is owned by SOCBOOST LTD or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute any part of the App without our prior written consent. All rights not expressly granted are reserved.

8. THIRD-PARTY SERVICES

The App may interact with third-party social media platforms or services. Your use of such platforms is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services or for any damages arising from your use of such services.

9. TERMINATION

We may suspend or terminate your access to the App at our sole discretion, with or without notice, if you violate this EULA or for any other reason. Upon termination, you must cease using the App and delete all copies from your device. Sections 6, 7, 10, 11, 12, 13, and 14 will survive termination.

10. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that analysis results will be accurate or reliable. You use the App at your own risk.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, SOCBOOST LTD and its affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the App. Our total liability to you will not exceed the amount you paid, if any, to access the App.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless SOCBOOST LTD, its affiliates, officers, directors, and agents from any claims, liabilities, damages, or costs (including attorneys’ fees) arising from your use of the App, violation of this EULA, or infringement of any third-party rights.

13. GOVERNING LAW AND JURISDICTION

This EULA is governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes arising under this EULA will be resolved exclusively in the state or federal courts located in San Francisco, California. You agree to submit to the jurisdiction of these courts.

14. MISCELLANEOUS

  • Severability: If any provision of this EULA is found unenforceable, the remaining provisions will remain in effect.

  • No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

  • Entire Agreement: This EULA, together with the Privacy Policy, constitutes the entire agreement between you and us regarding the App.

15. SUPPLEMENTAL TERMS FOR APPLE APP STORE

If you access the App through an Apple device, the following terms apply:

  1. This EULA is between you and SOCBOOST LTD; Apple is not a party.

  2. The license granted is limited to use on Apple devices you own or control, per Apple’s App Store Terms of Service.

  3. Apple is not responsible for the App, its content, or any maintenance or support.

  4. If the App fails to conform to any warranty, you may notify Apple for a refund of the purchase price, if any. Apple has no other warranty obligations.

  5. Apple is not responsible for addressing claims related to the App, including product liability, regulatory compliance, or intellectual property infringement.

  6. You represent that you are not located in a U.S.-embargoed country or on a U.S. Government restricted list.

  7. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

  8. We authorize use of the App via Apple’s Family Sharing or similar functionality, where applicable.
